Why this policy exists
Email deliverability is a shared resource — when one sender abuses it, mailbox providers penalize everyone on the same infrastructure. This policy exists to keep Peleka’s sending reputation healthy so your email actually reaches the inbox. It is part of, and incorporated into, our Terms of Service.
Permission-based sending, always
You may only email people who have affirmatively agreed to hear from you — through a signup form, a checkout opt-in, or another clear, documented action. The following are never allowed on Peleka:
- Purchased, rented, scraped, or appended contact lists
- Lists obtained through co-registration or incentivized signups without clear disclosure
- Email addresses harvested from public directories or the web
- Contacts imported from a third party without their consent to be contacted by you specifically
Prohibited content
You may not use Peleka to send content that:
- Is illegal, fraudulent, or promotes illegal activity
- Involves multi-level marketing, pyramid schemes, or get-rich-quick offers
- Promotes hate speech, harassment, or violence against individuals or groups
- Contains malware, phishing attempts, or deceptive links designed to steal credentials or personal information
- Involves unlicensed pharmaceuticals, weapons, or regulated substances
- Constitutes adult content, gambling, or other content restricted in your recipients’ jurisdiction without appropriate compliance
- Infringes someone else’s intellectual property or impersonates another person or business
Prohibited sending practices
Even with a permission-based list, the following practices are not allowed:
- Falsifying header information or sender identity
- Using misleading or deceptive subject lines
- Omitting a working unsubscribe link or a valid postal address
- Failing to honor unsubscribe requests promptly
- Continuing to send to addresses that bounce, complain, or are flagged as spam traps
- Sending at a volume or frequency inconsistent with what recipients agreed to
Complaint and bounce thresholds
We monitor spam-complaint rates, bounce rates, and unsubscribe rates across all sends, with extra scrutiny while a new sending domain is warming up — if complaint or bounce rates exceed safe thresholds during that period, sending is automatically paused while we investigate. Outside of warmup, accounts with consistently high complaint or bounce rates are reviewed and may be throttled or suspended under the Enforcement section below, even if no individual message violates this policy.
Legal compliance
You’re responsible for complying with the email and privacy laws that apply to your sends, including CAN-SPAM (US), CASL (Canada), GDPR and PECR (EU/UK), and any equivalent law in your recipients’ countries. This includes honoring consent requirements, providing required disclosures, and processing opt-outs within the legally mandated timeframe.
Enforcement
Depending on severity, violations of this policy may result in content removal, sending suspension, mandatory list cleaning, account throttling, or immediate account termination without refund. We reserve the right to review account activity, including message content and sending patterns, to enforce this policy. We try to warn and work with senders acting in good faith, but severe violations — like harvested lists, phishing, or malware — may result in immediate termination.
Reporting abuse
If you receive spam or suspect an account is misusing Peleka, email [email protected] with the message headers or a forwarded copy. We investigate every report.
Changes to this policy
We may update this policy as sending standards and regulations evolve. Material changes will be communicated by email or through the product before they take effect.
